End User License Agreement (EULA) for Smingle

This End User License Agreement ("Agreement") is a legal agreement between you ("User," "You," or "Your") and Smingle Labs Private Limited ("Smingle," "Company," "We," "Us," or "Our") regarding your use of the Smingle mobile application ("Application" or "App"). By downloading, installing, or using Smingle, you agree to be bound by the terms of this Agreement. If you do not agree, do not download, install, or use the Application.

1. License Grant

Smingle grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application solely for your personal, non-commercial use, in accordance with this Agreement.

2. User Eligibility

You must be at least 18 years old to use Smingle. By using the App, you confirm that you meet this requirement.

3. User Responsibilities

You agree to use the Application in compliance with all applicable laws and regulations.
You will not use the Application to engage in harassment, abuse, or any other offensive conduct.
You are responsible for maintaining the confidentiality of your login credentials.
You agree not to upload, post, or transmit content that is illegal, harmful, or violates the rights of others.

4. Prohibited Conduct

You agree not to:

Reverse engineer, decompile, or disassemble the Application.
Use the Application for any unauthorized commercial purpose.
Impersonate any person or entity.
Post content involving nudity, violence, or hate speech.
Distribute spam, chain letters, or pyramid schemes.

5. Content and User-Generated Content

5.1 Acceptance of Terms and Prohibited Content

By using Smingle and engaging in any activity that involves User-Generated Content, you agree to abide by the rules and expectations outlined in this Agreement. We maintain a strict zero-tolerance policy toward objectionable content and abusive users. Prohibited content includes, but is not limited to:

Illegal content or activity
Harassment, threats, or personal attacks
Defamatory, obscene, or vulgar content
Content that is hateful, discriminatory, or incites violence
Anything that violates privacy or intellectual property rights

Violation of these terms may result in immediate action, including content removal, warnings, or permanent account suspension.

5.2 Mechanism for Blocking Abusive Users

To support a safe user environment, Smingle allows users to block others. Blocking a user restricts them from messaging or interacting with you. This function can be accessed:

From the user's profile
Within the chat interface

This feature helps prevent repeat harassment or unwanted interactions.

5.3 Reporting and Content Moderation

Smingle provides an easy-to-use in-app reporting tool. Users can report inappropriate behavior or content by:

Selecting "Report" on a profile
Selecting "Report" on chat screen
Selecting "Contact us" on their Profile Screen

Our moderation team reviews each report within 24 hours. If content is found to violate our policies, it will be removed and the offending user may face suspension or termination. We strive to notify affected users of the outcome of their report.

5.4 Definition of User-Generated Content

"User-Generated Content" refers to all content submitted by users on the platform, including:

Profile details (bios, prompts, etc.)
Messages, voice notes and any media shared via chat
Uploaded photos and videos

Users are solely responsible for the content they share. By submitting content, you grant Smingle a non-exclusive, royalty-free, worldwide license to use, display, and distribute the content in connection with the operation of the Service.

6. Child Sexual Abuse Material (CSAM) and Exploitation Prevention

Smingle has zero tolerance for child sexual abuse material or any form of exploitation involving minors. We:

Proactively monitor user-generated content through automated and manual review systems.
Provide in-app reporting tools for immediate user action.
Cooperate fully with law enforcement agencies.
Immediately investigate and act on any reports related to CSAM or abuse.
Terminate accounts and remove content associated with any confirmed violations.

Any suspected incidents will be reported to relevant national and regional authorities in accordance with applicable law.

7. Privacy

Your use of the Application is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. You can read the full policy at:

We are committed to:

Safeguarding your personal information.
Not selling or disclosing your data without consent, except where legally required.
Complying with India's Digital Personal Data Protection (DPDP) Act, 2023 and the Information Technology Act, 2000.

8. Third-Party Events and Interactions Disclaimer

Smingle displays curated events and activities for discovery purposes only. These events may be hosted or managed by third-party providers, organizers, or venues. We:

Do not own, operate, or manage these third-party events unless explicitly stated.
Are not responsible for the safety, quality, or conduct of these events or the people attending.
Do not verify or endorse any third-party individuals or businesses involved.

Participation in an event or meeting with another user is solely at your own risk. Smingle is not liable for any outcomes of such interactions or real-life meetings arranged through the platform.

9. In-App Purchases and Subscriptions

Smingle may offer optional in-app purchases and subscription plans. By making a purchase, you agree that:

Prices are clearly displayed and subject to change.
Subscriptions auto-renew unless canceled at least 24 hours before the renewal date.
Payment is charged to your Apple ID or Google Play account upon confirmation.
You can manage and cancel your subscription via your Apple or Google account settings.
Refunds are handled by Apple or Google in accordance with their respective policies.

10. User Reviews and Feedback

Users may leave reviews and submit feedback via the App Store or Play Store. Smingle:

Does not alter or remove user reviews except where required by the platform's guidelines.
May respond to user reviews to resolve issues or provide support.
Encourages respectful, honest, and constructive feedback.

11. Indemnity

You agree to indemnify, defend, and hold harmless Smingle Labs Private Limited and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including legal fees and costs, arising out of or in any way connected with:

Your access to or use of the Application;
Your violation of this Agreement;
Your violation of any third-party rights, including intellectual property or privacy rights;
Any claim that your User-Generated Content caused damage to a third party;
Any harm or liability arising from offline interactions or attendance at third-party events.

This indemnity obligation will survive the termination or expiration of this Agreement and your use of the Application.

12. Limitation of Liability

To the fullest extent permitted by law, Smingle shall not be liable for:

Any direct, indirect, incidental, special, or consequential damages resulting from your use of or inability to use the Application.
Any damages or claims arising from in-person meetings, third-party events, or offline interactions initiated through the App.
User-generated content or the behavior of any user.

Smingle's liability is strictly limited to moderating and managing digital content hosted within the Application.

13. Termination

We reserve the right to terminate or suspend your access to the Application at our sole discretion, without notice, for conduct that we believe violates this Agreement or is harmful to other users or Smingle.

14. Disclaimer of Warranties

The Application is provided "as is" and "as available" without warranties of any kind. Smingle disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose and non-infringement.

15. Modifications to the Agreement

We reserve the right to modify this Agreement at any time. Continued use of the Application following any changes constitutes your acceptance of the revised Agreement.

16. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India. All disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

17. Platform-Specific Terms

Apple App Store Terms

This Agreement is between you and Smingle Labs Private Limited, not Apple Inc.
Apple is not responsible for the Application or its contents.
Apple has no obligation to furnish any maintenance or support services.
If the Application fails to conform to any applicable warranty, you may notify Apple and they may refund the purchase price (if any). Apple shall have no other warranty obligation.
You agree to comply with applicable third-party terms when using the Application.
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement and may enforce this Agreement against you as a third-party beneficiary.

Google Play Terms

You acknowledge this Agreement is between you and Smingle Labs Private Limited and not Google LLC.
Google is not responsible for support or maintenance of the Application.
Use of the Application must comply with the latest Google Play Terms of Service.

18. Usage Rules and Third-Party Services

This License Agreement may not provide for usage rules for the Licensed Application that are in conflict with the latest Apple Media Services Terms and Conditions and Google Play Terms of Service ("Usage Rules"). Smingle Labs Private Limited acknowledges that it had the opportunity to review the Usage Rules and this License Agreement is not conflicting with them.

Smingle, when purchased or downloaded through the Services, is licensed to You for use only under the terms of this License Agreement. The Licensor reserves all rights not expressly granted to You. Smingle is to be used on devices that operate with Apple's operating systems ("iOS") or Google's operating system ("Android").
